Our song was on the national weather report...

Haha, how strange! It was on in the background to the late night national news, on TV3. During the weather forecast. Surely they should ask us first? Anyway, awesome!

They are under no obligation whatsoever to get your permission (hence the controversy of National's use of certain music). Al NZ tv stations have flat fee licences with APRA. If you are APRA registered you will get royalties from their use of your song. A few hundred at least.

How come NZ TV stations have special rights to music? That doesn't sound right. But come oooon sweet APRA payout!

Because they negotiated the deal with APRA (same as radio stations and bars and shops and such do, and the same as you could do if you wanted). It's not even that expensive - from memory, about 2.5% of annual advertising revenue for them, plus some more for the mechanical rights.

You signed your rights over to APRA, maybe through a few intermediaries, and they enforce them and onsell them at a standard rate to TV3. They'll send you a cheque in six months for both parts. It won't be a huge amount, but some. APRA actually have a pretty good website these days where you can read about the gory details: www.apra.co.nz.

You do have moral rights to the music that would allow you to object, but not much more, if National wanted to use it as campaign music. They are all more complicated to deal with and basically meaningless most of the time.

thanks for that info Mark! So they can only do this to music that's registered with APRA then?

No clue, man (incidentally I wasn't the one who posted the second anonymous comment!).
